K. T. Shah that under the'old regime all executive action was expressed in' the name of the Government of India my reply is that that was due to the fact that under the old system the civil and military Government of India was vested not in the Governor-General but in the Governor-General in Council and consequently all action had to be expressed in the name of the Government of India. [...] of asking the Cabinet to consider the pros and cons of the proposed legislation so that the administration of the -province does not suffer either to the detriment of the Ministers of the Province or of the Government of India as a whole. [...] It says: It shall be the duty of the Chief Minister to communicate to the Governor all decisions of the Council of Ministers relating to the administration of the affairs of the State and proposals for legislation." This is a work which can be and is left to the Chief Secretary of the Government. [...] Will the Chief Minister be guilty of breach of duty if for any reason the Chief Secretary or the Secretary in charge does not forward the copy of the proceedings of the Council of Ministers to the Governor? [...].1 think tizat the whole secticr is very badly worded and this clause should be worded in this way:— The Governor may call for any information relating to the administration of the affairs of the State and such information shall be furnished to him if in the opinion of the Chief Minister such information is necesssary for a proper exercise of the duties of the Governor."
