WHEREAS it is expedient to remove the easily preventible causes for the shortage of cattle stock and the reduction of the milk supply in British India; and whereas the overseas trade in cattle has substatially contributed to the said shortage of cattle stock and the said reduction of milk supply; It is hereby enacted as follows (1) This Act may be called the Indian Cattle Export Prohibtion A [...] The deletion of the clause would not be in accordance with the intention of the Bar Councils Committee not indeed with the principle recognized. [...] Recent events connected with the use of the provisions of section 144 of the Code of Criminal Procedure 1898 for the purpose of imposing restrictions of all kinds on political workers and propaganda with the object of counteracting or suppressing political agitation or other legitimate activity whenever and wherever the authorities deem fit to do so have disclosed the need for a re-definiti [...] The words of the section were from the very nature of the entirely temporary action contemplated made very general and the discretion left to the Magistrates for the purpose was also correspondingly wide. [...] In any case the revision of the terms of the section so as to clearly define and restrict the powers.of Magistrates and to provide adequate safeguards for the protection of the rights of the public and of individuals is clearly called for.
