In the matter of a petition to set aside the election of Khwaja Sir Nazimuddin to the Bengal Legisltive Assembly from the Calcutta North (Muhammadan) Urban Consttuency in the Bengal election held on the 25th February 1937 and In the matter of election petition for decision of doubts and disputes as to the validity of an electioName—Muhammad Siddiqui. [...] Although the original petition which was presented on the 22nd April 1937 contained a number of vague allegations of certain corrupt practices on the part of the respondent the statement contained in paragraph 6 of the petition supplemented by the list of alleged corrupt practices appended thereto could by no stretch of the imagnation be regarded as a list setting forth full particulars of [...] The main question which arises for consideration in connection with the preliminary issue is whether or not the particulars of the alleged corrupt practices which were supplied with the original petition on the 22nd April 1937 were full particulars within the meaning of rule 27(2) and to what extent if any the petitioner can be allowed to supplement these particulars after the expiry of the peri [...] In this connection the learned Commissioners in the Akyab case observe : — "We agree with the decision in that case and with the remarks that what was sought was the amendment of the listof partculars by adding to them while the rule only allowed amendment of the particulars in the list (already) by amplification or the giving of further details. [...] In providing that the original petition shall set out the material facts upon which the petitioner relies together with full particulars of any corrupt practice which he alleges the intention of the framers of the Election Petitions Rules" was obviously to ensure that the petition should be a bona fide petition based upon specific instances of corrupt or improper conduct on the part of the respon
