JULY 25 1953 2. The notification stated 19 items of dispute and with the consent of the parties the following 20 issues were framed to cover all the points of references: 1. Is the Union competent to represent all the members of the Union as well as the categories excluded on the 5th Noveber 1951 from the Union ? 2. (a) Has the Tribunal jurisdiction to adjudicate upon the 1st demand of the Uni [...] In Exhibit C the Union offered to exclude the categories of staff regarding which the company had objected and on receipt of Exhibit C the company sent Exhibit B in reply by which it accorded its recognition to the union subject to the condition that : ti if at any time in the future the union wishes to include or represent any member of the categories of staff now excluded from its membership t [...] The conditions wished to safeguard against any victimization of the excluded category of the staff and further stated that : '' in the final agreement drawn up as a result of the fortcoming negotiations the union would see to it that certain clauses for the benefit of the ecluded categories of staff are included in it. [...] In any case the important point is that in none of these conditions there is any right reserved by the union to represent the excluded categories and secondly as stated above the union agreed to the unqualified condition imposed by the company that.. if at any time in the future the union wishes to include or represent any number of the category of staff now excluded from its membership the rec [...] I accordingly award that to the Provident Fund constituted by the company the contribution of the company shall be 5% of the basic salary earned by the employee each month and the contribution of the employee shall be 10% of such salary.
