2. In section 3 of the Bengal Embankment Act 1882 (hereinafter referred to as the said Act) in the definition of the term embankment " after the word " training-wall " the word " berm " shall be inserted. [...] The word " berm " has however been inadvertently omitted in section 3 under the definition of " Embankment " and the result has been that cases of damage done to berms brought before a court of law are invariably dimissed because of the omission of the word " berm " in section 3 of the Act. [...] It has therefore become necessary to include the word " berm " in the definition of " Embankment " in section 3 of the Bengal Embankment Act 1882. [...] The intention of the second paragraph of section 61 of the Bengal Embankment Act 1882 is that interest should be charged from the date of apportionment on the amount charged to or apportioned on any estate or tenure less any instalment of such amount paid from time to time. [...] In the opinion of the High Court this paragraph as it stands at present is not clear ; and owing to a recent judgment delivered in a case Government is precluded from levying interest on the cost of works undertaken under the Act from the date of apportionment of those works among the persons benefited.
