The Judge has found as a fact that the demand for a patta was duly made at the time when the sale under the Act took place ; the tenant for whose arrears the land had been attached had no saleable inter- est in the land, he having conveyed the same to the respondent and the appellant had notidt of that transfer before he proceeded to sell the sup- posed interest of the former tenant. [...] The judgment of the Collector amending the patta and informing the defendant of the terms on which he is to execute a muchalka constitutes a sufficient tender to entitle the landlord to enforce the terms of the patta. [...] El The Munsif dismissed the suit on the ground that the date fixed for the sale under Suction 33 of the Rent Recovery Act was the 15th, not the 16th of November. [...] A small cause dseeree of the tomer Court having been sent by the Subordinate Judge to the Court el the District Munsd for execution against the said property under the provisions of Section 20 of Act NI of 1E65, the applAticn for execution was rejected by the Ivluntin on the ground that this procedure mos illegal. [...] On the part of the plaintiff, it is contended that, in respect of the lain in excess of 57 kanis, the defendant was not a landholder within the definition of that term in the Rent Act, and that inasmuch as the whole ' Second Appeal 805 of 1883.
