After the widow’ death her mother-in-law succeeded to the lands as the next reversioner and after her death the sons of the widow’ daughter went into possession of the lands as the reversioners of the adopted son of the widow. [...] In a suit by the members of the family for posses sion of the lands against the widow’ daughter’ sons: 1947 13/1 & 2 Held that (1) it could not be presumed under the circumstances that the plaintiffs allowed the widow to remain in possession of the suit lands as a widow of their deceased coparcener in order to pro. [...] (2) of the Act expressly provides that the Act extends to the whole of British India but it applies only to persons who but for the passing of this Act would have been subject to the law of Mitakshara in respect of the provision therein enacted. [...] The owner of the land on the lower level being subject to a disadvantage enjoined by nature has got to submit to all the consequences resulting from the owner of the upper land using that land in a natural way for the purpose of draining it or for the purpose of agricultural operations. [...] But if the owner of the land on a higher level uses the land in an unnatural way or in the course of draining operations collects the water in one body and discharges it on the land on the lower level then although the proprietor of the land on the lower level is bound to receive that body of water he has a cause of action if as a result his land is subjected to a damage greater than what it would
