Before going into the legal aspect of this subject, it is, I think, desirable to urge that this arti- cle is not intended only to draw the atten- tion of the lawyers and the Magistrates concerned with the issue of processes in criminal trials, rather it is intended to draw the attention of the II on'ble the Chief Justice of the Hon'ble High Court and also the Advocate-General of the Province and, [...] 190, Criminal P. C. , assumes jurisdiction in a criminal case and applies his mind to the suspected commission of the alleged offence and whenever the accused has not been brought before the Magistrate, it issues a summons for the appearance of the accused and fixes a date and on the date so fixed, in the majority of cases, at least about 90 percent. , in which the accused is not physically present, [...] I personally know of a case in which I was representing the accused per- son and as the accused was not at his head- quarters and had no information of the case or the summons, I advised the younger brother of the accused to file a petition to the Court stating the facts and praying that a date for his appearance be fixed on which date the accused would positively appear. [...] randum only, unless the statement comes within the purview of Proviso 2 to S. 162, Criminal P. C. In such a case the accused should be given a copy as of right, unless the Court is of opinion that it is irrelevant to the case, or that it is not in the interest of the accused to disclose it and is inexpe- dient in the public interest to do so. [...] In a criminal case a First Class Magistrate looked into the police diaries after the evidence for both the sides was closed and the arguments were heard, and from such perusal of the diaries he found that the defence set up by the accused in the Court was not the same as that set up by him in the police diaries.
