was decided on this point by two of the Judges, who expressly declined to go into another question, as to the validity of a direction to accumulate income the judgments of the third Judge in the appellate Court, and of the Judge in the Court below, on the latter point, were therefore mere obiter dicta, and the case is only an authority upon the construction of a particular will, and should, I thin [...] But the reporter informs us in his head-note of the nature of the mortgaged property, the amount of the mortatge- moneys, and the various stages, with the exact dates, of the liti gation, in the High Court and the lower Court, between the mortgagee and the mortgagor. [...] Nevertheless, the reporter has filled ten pages with a statement of facts, the judgment of the High Court and the entire judgment of the Privy Council which sets out the exact terms of the mortgage deed and the history of the suit in the lower Courts. [...] Only that portion of the iu-tgrnent should be given which deals with the point for the sake of which the case was reported, and the reporter should also eliminate all recitals of the evidence, and the reasoning of the Court thereon. [...] He was only entitled under clause 4 of the indent to dispose of the goods on A's account and until he did so A's right as purchaser to the goods on payment existed and B had no right to refuse the tender of the cheque by A. A was entitled to the amount Of difference between the market value of the goods on the day on which he sent the cheque and the amount due by him on the draft as damages.
