The jurisdiction of the Privy Council more correctly known as the Judicial Committee of the Privy Coun- cil was in itself the jurisdiction and is in fact still the jurisdiction of the Sovereign in Council arising out of the common law of the Royal prerogative (1). [...] But in their result they closely follow the main channel along which the sovereignty of the individual has become transferred and distributed amongst the people the crowning piece of which is to be found in the Articles of Independence by which the sovereignty of State of the United States of America is declared to vest in the people. [...] Sir James Stephen has summed up the present survival of the judicial authority of the Privy Council in the following words : From the most remote antiquity the admi- nistration of justice was the highest or one of the highest prerogatives of the sovereigns of this country and his council or Court was the organ by which that prerogative was exer- cised.
