617 (Bho_ laumar v. Kausilla) regarding the effect of remarriage of Hindu widows accord- ing to custom on the property inherited from the first husband and it is proposed to examine this aspect of the decision without any reference to the applicabi- lity or otherwise of S. 2 Act 15 of 1856 or the question of stare decisis. [...] It would be advisable to bear in mind that the underlying conception of widow’s estate is that she is the surviving por- tion of her husband and where the rule as to remarriage is relaxed and second marriage is permitted it cannot be sup- posed that the law which these castes follow would permit the remarried widow to retain the property in the absence of any basis for the continuance of the fic- [...] Further the law of adoption and the power of the widows to adopt is largely based on the conception that she is the better-half of the husband and the theory of presumptive authority is a glaring instance in point. [...] In view of the Bombay and Madras decisions on the point given by several eminent Hindu Judges after a detailed examination of the Smritis and the commentaries as well as the opi- nion of the well-known ancient sages the time is now opportune for the Allahabad High Court to review the decision laid down in Padam Kumari v. Suraj Kumari (6) or subsequent judgments to the same effect and the sooner i [...] In the interests of Hindu society which is disrupted by innumerable castes and sub-castes and having regard to the progressive state of the times the decisions of the Bombay and the Madras High Courts declaring the validity of anuloma marriages should be most wel- come and it is to be hoped that the other High Courts will also adopt the same view.
