26, R. 1 (3) — Suit for payment of money—For applicability of subrule main relief claimed in suit mast be for payment of money —Suit for possession of immovable and movable property including ornaments — Reliefs for account of usufruct of property and for return of sum of money also claimed in suit — Suit held not for payment of money 124b —0. [...] He is also entitled to take judi- cial notice of proceedings in the Assembly not of the truth of the facts asserted in the speeches but of the fact that such speeches were made. [...] It becomes sedition under S. 124-A, Penal Code, only when the intention or the attempt is to induce people to cease to obey the law and to cease to uphold lawful authority; and it falls under S. 4, Press (Emer- gency Powers) Act if the matter complained of tends to produce that result or is likely to do so. [...] 127 of 1945 did not lie because in to far as it seeks to challenge the notice of 21st November 1995 it is ineffective for the reason that the notice is a nullity; and as regards the second notice of Soth November 1945, it has never been formally challenged and any challenge made to it at this stage would be beyond the limitation of two months prescribed by S. 23. [...] The notice of forfeiture was addressed to the keeper of the press and was accepted by the keeper and was acted on by both parties and treated as a regular and proper one.
