Some indication of the reason for the decision is however to be found on the ground of public policy and some in the answers to the argument at the Bar. [...] THE Couirr.--On the terms of the 'agreement the attorney is entitled upon his ceasing to act at the instance of the.Defendant to have the costs incurred taxed in the. [...] This was an application by the Plaintiff upon a summons for an order for payment to him by the Accountant-General of the balance of a sum of money paid into Court by the Receiver appointed at the instance of the Plaintiff over certain immovable property of the Defendant after payment of cots or in the alternative that it he referred to the Registrar to report whO ware the persons if any ent [...] Belchambers was appointed Receiver to collect from the tenants the rents of the property above referred to and was directed after payment thereout of charges.and commission to pay the balance of the amounts so to be realised into Court to the credit of this suit subject to the further order of this Court. [...] Ordered --That it be referred to the Registrar to report who are the persons if any who are entitled to 'participate in the fund besides the Plaintiff Costs of all parties other than the Defendants of this application to be paid out of the balance of the fund in Court before distribution and after satisfying the costs of realisation including the Plainti(l's costs of this application.
