The present suit was commenced by him to recover the Chidikada estate on the ground that by the terms of the first grant that of 1848 the then grantee became the sole and absolute owner of that property and by 11 inch law on the death of his widow the Plaintiff-Appellant was the rightful successor thereto. [...] Upon the return of the findings the Commissioner thought them unsatisfactory and himself sent for the settlment file and dismissed the suit with costs of both Courts arriving at the conclusion that whereas under the old settlement the profits of Loknath were to the profits of the whole estate as 1 to under the new settlement they were as 1 to 4. On the appeal of Bissessarnath the Judicial Comm [...] This was a Rule obtained on the 2nd of June 1899 against the order of the District Magistrate of IVIonghyr dated the 28th April 1899 passed in revsion of the order of the Sub-Divisional Magistrate of Beguserai dated the 23rd of March 1899 and 14th of April 1899. [...] The District Magistrate in forwarding the case to the Sub-Divisional Magistrate directed him to "restrict the enquiry carefully to the matter of the charge." As the result of the enquiry which followed the Sub-Divisional Magistrate found that Poorna Chunder Pal had withheld the fact of his dismissal from the Police both from Baba Mon Mohan Ghose who had certified to his character and from the [...] 244 of the Code of Civil Procedure applies to the case and the fact that the repres'entatives of the judgment-debtors claim not through the judgmendebtor but-adversely to him would not prevent the operation of that section.
