The introduction of a Bill of this nature at the close of the present century and the extension of punislinaent by whipping after all our prison reforms the establishment of Reformatory Schools and the introduction into this country of the First Offenders Act is much to be regretted. [...] Ritchie stated that the supporters of the Bill greatly regretted the necessity of the Bill but they entirely believed that the circumstances of the case fully justified the measure. [...] The points raised were (1) the construction of the grant of 1836 to Lal Barmeswar ; (2) the construction of the dwami pattah of 1849 to Rain Golam Rant and (3) whether the suit was barred by limitation owing to the fact that the claim of Ram Golam Rant to hold under a permanent lease had come to the Raja's notice in 1879 that is more than 12 yearS prior to the institution of the suit when it [...] The Plaintiff appealed to the High Court and cotended that he was entitled to a decree for the full amount of his claim ; and it was urged on his behalf that the Subordinate Judge was not right in throw;: ing upon him the onus of proving the passing of the consideration-money ; that execution of the bond was proved and the onus of proving the non-passing of the consideration lay upon the D [...] 10 was a bond fide purchaser for value and that in the circustances of the case the onus lay upon the Plaintiff to prove the passing' of the consideration-money.
