There can be no excuse for a journalist to be ignorant of the Despatch of the Secretary of State and the appointments made within the last three months and there is absolutely no justification for draggi4 the names of the judges who were appointed long ago both of whom were well-known members of the Bar at home and have since coming out to this country earned the esteem of the profession and th [...] The first three Defendants were the heirs of the mortgagee ; and the Plaintiffs' two elder brothers were the pro forma Defendants in the suit which was brought to recover the Plaintiffs' share in the mortgaged property. [...] The son of the mortgagee one Zuhurul Hug sued upon the mortgage ; and in execution of the ex parte decree which he obtained on the 29th October 1881 against the five sons of the deceased mortgagor the share hypothecated was sold and the decree-holder obtained possession thereof in January 1883. [...] At the time of the mortgage suit only the eldest son of the mortgagor was of full age the remaiing four sons—including the present Plaintiffs—were all minors and purported in the proceedings to be under the guardianship of their mother Moti Rani Koer. [...] 1 to 3 who were the prin.cipal Defendants in the suit contended inter alia that the Plaintiffs were properly represented that the decree and the sale were binding upon them that Tilakdhari was the head of the family to which the Plaintiffs belonged and that he borrowed the money to meet necessary and proper expenses of the family.
