136 of the Transfer of Property Act at the Committee stage Of the bill to amend the law in respect of actionable claims: The object of this is thus stated in the report of the Select Committee :— “We have altered the language of the section so as to cover the case of a practitioner who stipulates for an interest in the subject-matter of a suit. [...] As for a claim to copyright in newspaper reports of speeches it may with some propriety be said that such reports are the result of the exercise of consderable ingenuity on the part of the reporter and also of literary labour on the part of the editor. [...] Justice North said the decision of the matter rested on the construction of the schedule to the Bills of Sale Act and the bill of sale executed by the Plaintiff herein and that really was the subjecmatter to be decided in the action between the parties. [...] On apps 1)ythe tenant Defendants the lower Appellatit Court reversed that decree holding that the suit was cognizable by the Court of Small Causes and not by that of the Munsif and it directed the plaint to be returned to the Plaintiff for presentation to the proper Court." "Against that decision the Plaintiff preferred the present appeal. [...] THE COURT made the following order :— I will make an order that it appearing thatt the property is in the possession of the judgment-debtors the Sheriff do give possession to the purchaser if necessary by turning out the judgment-debtors or any person who refuses to vacate the same.
