The District Magistrate being the head of the Police and the Police being in possession of his car from the earliest stage of the proceeding he is not very unnaturally prone to favour the Police view rather than that of the defence about which he knows so little. [...] The Sub-Judge of Agra held that the Respondent had not made out by evidence the agreement alleged by him and his suit therefore failed: The High Court on the other hand held that the Respondent's story accorded with the probabilities of the case and was sufficiently proved and no question of limitation arose. [...] 499 refers to inspection of the subject of the suit and it cannot be said that what the Plaintiff wants is inspection of the subject of the suit. [...] A further enquiry was ordered by the High Court on the 7th November 1899 on a rule obtained by the complainant and the ground upon which the order proceeded was that the Presidency Magistrate had not examined some of the witnesses for the prosecution. [...] The Plaintiff then moved the High Court and obtained the present rule and it ' was contended on his behalf that all the three grounds upon which the judgment of the Munsif proceeded were wrong in law and consequently the decree of the Court below was open to revision by the High Court under sec.:25 of the Provincial Small Cause Court Act.
