1) of the Banruptcy Act of 1883 and ordered the Company to deliver up and pay to the trustee the whole of the property and assets of the bankrupt and in addition ordered that each of the five directors do deliver-and pay to the trustee all such property and assets as were then and had been in his possession or control and moreover to account for such parts thereof as had been but were not the [...] On the 12th March 1900 The Divisional Bench supported the decision o the County Court Judge as regards the Company owing to the abundant evidence of fraud on the part of the bankrupt Stephen Ely ; but concerning the directors the Court held that there.vas no proof that the directors had helped the bankrupt to defraud his creditors there was no evidence of utala fides on the 'Art of tile director [...] In the COURT OF APPEAL the Master of the Rolls Lords Justices Rigby and Collins on the 19th of May unanimously upheld the decision of the Divisional Court and dismissed the appeal with costs. [...] Questions of fact were raised and tried the main question of law was the effect of those purchases the equities between the Plaintiff and the Raja and the right of Plaintiff to redeem &c. [...] In the event of the parties not so agreeing the records and evidence of all parties not so agreeing will b. sepa_ ratel*ranseribed and forwarded." The effect of the aghement was limited to the transcribing of the record and no such agreement was made.
