Then followed the clause in the agreement between the parties on which the question before the Court turned n4mely : "The prospector shall receive from the syndicate the sum of £250 on the flotation by the syndicate of every block of 10 claims pegged by the prospector." It appeared that in the course of his service under this agreement the Respondent pegged off 330 claims or 33 blocks of 10 cla [...] Discarding some of the suggested conditions of " flotation " on which the learned counsel for the Appellants no longer insisted such as the view that there could be no flotation unless the shares were publicly offered i or the notitn that the company must be actually working at a profit the fair result of the oral evidence seemed to be that the dispostion made by the syndicate of these mining [...] 26 27 and 28 of the regulations of 1890 said their Lordships were of opinion that the fulfilment of the requirements of those regulations did not enter into the definition eif the term "flotation " and was not a condition precedent to the agreement of July 1894 entered into between the Respondent and the Syndicate. [...] The District Judge of Hooghly agreeing in that view of the matter referred the ease to the High Court and recommended that the name of Jogendra Narayan Bose be removed from the roll of pleaders of the Munsif's Court at Anita where the pleader ordinarily practised. [...] The Munsif found that the pleader executed the promissory notes and that his conduct in the matter assuming that the Will propounded was genuine was still grossly improper and without maligng any definite recornmendattn in his report the Munsif asked the High Court to take into consideration the past good conduct of the pleader upon the question of punishment.
