In the course of time the Mexican Government became trustees of the fund and when the Jesuits were expell T the Dominicans and the Franciscans working th e became the beneficiaries. [...] The Court had to deal with the case now after it had been tried.' As to the real intetion of the parties relativt to the contract a quetion might have been put to the jury; if it was counsel’s view that the Judge should have taken the view of the jury upon the matter. [...] The Petitioner w.ho was the Plaintiff in the court of Small Causes at Bralimanbaria sued the Defenants for the recovery of a sum of money and based his claim upon a bond alleged to have been executed by the Defendant in favour of the Plaintiff. [...] The Defendants denied the claim and denied the exection of the bond and pleaded that not only did they lever borrow any money from the Plaintiff but that the Plaintiff was indebted to them in respect of two 15xvi THE CALCUTTA WEEKLY NOTES.
