Aftel the Staning Counsel had closed the case for the prosecution and the counsel for the defence intimated to the jury that he wished to call witnesses for the defence the jury wanted to pass their verdict before hearing the case for the defence. [...] It may sometimes happen that the Court might dicharge the jury and try the prisoner with a fresh jury the majority of whom was in attendance during the judge's summing up and verdict of the jury at the previous trial and it is difficult to say whether the minds of the jurors in such subsequent. [...] In the above case the jury empannelled were present.in Court during the summing up of the judge and the pronouncment of the verdict by the jury in the previous case which was also a prosecution under sec. [...] It therefore falls within the definition of codicil unless it is excluded on the ground that at the date of the addendum the Will was no longer the legal declaration of the testator. [...] At the close of the case for the prosecution Mitra intimated to the Court that he was going to call evidence on behalf of the accused and addressed the jury at length and in concluding his address he briefly indicated the nature of the evidence he proposed to call and mentioned the names of some of his witnesses.
