39 of the Small Cause Courts Act runs thus :- In any suit instituted in a Small Cause Court ill which the amount or value of the subject-Inatter exceeds the SUM of one thousand rupees the I ielcialant or any one of the Defenants may before the day fixed by the summons for the apearance of the Defendant or within eight days after the service of the surounms on him whichever period shall la [...] Unless the Judge is of opinion that the application has been e solely for the purp4se of delay the applicant shall be titled to such order as of right but it shall be lawful for the ge if ltt shall think fit in and by such order to require pplicant to gire security to a reasonable amount to be ified in the order for the payment of any costs which may me payable by him to the Plaintiff iu respe [...] The suit was defended by the said Maharajah and the Secretary of State who pleaded that the lands claimed formed a portion of the said Kajiar chur and that the suit was barred by limitation. [...] To ascertain the value the Superintendebt and Remembrancer of Legal Affairs in Bengal made a reference to the Collector of Mymensingh who after enquiry in the presence of the parties by' the Settlment Deputy Collector reported that the value may fairly be taken to be over Rs. [...] 10 009; but besides that the decree indirectly determined the title not only of Petitioner but of co-sharers in the estate and the proper valuation for the puposes of the appeal it was submitted was the value of the whole estate and not only of the 10 annas share of Petitioner.
