held that the date of the institution of a suit should be reckoned from the date of the prsentation of the plaint and not from the date on which the requisite court-fees are subsequently paid so as to make it admissible as a plaint. Code referred to the succeeding words " any matter in difference between them in the suit " so that where persons who were not parties to the award and who had never put in appearance in the Court and between whom and any of the parties to the submission there was not in fact any matter in difference sued to set aside the award on the ground that they had not joined in the reference [...] The damage was in the Crosby Chanel and it was caused by the wreck of a steamer called the " Heschell."
