At the conclusion of the Sepoy War and on the transference of the Company’s Government to the British Crown it was therefore thought advisable in 1857 to reaffirm generallay the treaty rights and to convey assurance to the Chiefs that the rights of succession and adoption would be respected by the Paramount Power. [...] Held—That the younger brothel's were not liable on the bond the agreement not having been perfected Ayyangar J. adding that if the parties intended that all the members of the family should execute the docment it cannot take effect by reason that the person who alone executed the document happens to be the managing member and that the debt is recited to have been incurred for the benefit o [...] By the terms of the said agreement the Associated Guarantors undertook to procure that the new Company to be formed would allot such number of its shares to be of the value of £1/12/ paid up on the issued shares as the old Company should require to satisfy all its liabilities. [...] This matter came on for hearing before the Judge in Chambers for the summary investigation of the claim of one Kishori Lal Chowdhury to some land and premises attached by a prohibitory order of this Court at the instance of the Plaintiffs in execution of a decree against the Defendant tar* Sing. [...] The defence was that the snit was barred by limitation that the Defendants had been in possession all along as tenants under the same maliks and that the Plaintiff's allegation of possession and subsequent dispossession was false and the lewTe set up by the Plaintiffs collusive.
