A consderation of the development of the law of treason would point out that with the gradual breaking up of the feudal system and the increase in the personal power of the monarch it was attempted to widen its range so as to make it a powerful instrment for upholding the despotism of the monarch. [...] With the increase in the power of the King the power of the feudal lords diminished. [...] The book deals with the subject of parties to such suits the allegations to be made in the plaint the various defences to be raised and the forms of decrees. [...] Justice Kekewich agreed with that view being of opinion that the transaction of the surrender was tantamount to a purchtst of the shares by the Company the price given being the release of the directors from the liability of the uncalled amount of £1 per share ; but the learned Judge was of opinion that notwithstanding that the surrender of the shares was void still the application to restor [...] process against the preperty or person of the debtor required the determination of the question whether the imprisonment was meant to be one as a means of enforcing payment of the debt or whether the intention was punitive.
