We do not know which of the appointments the writer refers to as effected by the “clamours.” We suppose the latter is referred to as the writer mentions that the claims of a member of the Provincial service to a Small Catise Court appointment are about to be overlooked. [...] - But the provision does not apply to oases of treason in compassing and imagiing the death of the sovereign (or misprision of such treason) when the overt act is an act against the life or person of the sovereign. [...] * The indictment against Lynch charged as overt acts the making of the declaration and the taking of the oaths and the acts of hostility both witin the territory of the Republic and the Colony of Natal. [...] 4143 P. C. did not bring the case within the section in the absence of any finding or clear evidence that the acts involved a breach of the peace oL an evident intention gf committing the same as the section did not itself necessarily involve a breach of the peace. [...] The Magistrate should follow the possession given to the anctiopurchaser in execution of a decree and not discuss the rights of the parties under the decree.
