At the desire of the Appellant the Chief Court of the Punjab by order dated the 13th January 1896 transferred the case for trial from the Court of the 222"VOL. [...] On the 22nd January 1896 the Appellant applied to the said Chief Court to set aside the said warrant of arrest and the proceedings taken in pursuance thereof orrthe ground inter ilia that the arrest of the Appellant a native of Hyderabad in the terrtories of His Highness the Nizam was illegal. [...] On the 6th April 1896 the trial of the Appollafit was continued in the Court of the District Magitrate of Umbalit ; the evidence for the prosecution was concluded ; the accused was examined and charges framed against him. [...] Having obtained the said order in Council dated the 3rd August 1897 the Appellant on the 2nd May 1898 sent a notice to the Secretary to the Government of the Punjab" on behalf of the "Secrtary of State in Council." This notice purported to be sent under the provisions of sec. [...] The plaint stated in detail the proceedings already referred to in the criminal case alleging that the Magistrate of Simla Captain Beadon issued the warrant for the Plaintiff's (Appellant's) arrest on the application of the Defendant (Respondent) through the officials of the Government of India well knowing that he had no power authority or jurisdiction to issue such a Warrant" and charged th
