The unusually large gathering of the members of the Bar signified to the popularity of the young judge. [...] Thus a suit has been allowed against one Of several partners the others being without the jurisdiction Obihe ground that the claims of the litigants could be settled without prejudicing the rights of the absent parties (8) ; while in a similar suit against one of several part owners of a vessel the Court dismissed the suit on the ground that no just settlement could be made in the absence of th [...] Further in the face of Plaintiff's evdence and that of his witnesses and the admissions of the Defendant if the verdict went upon the ground that the words were mere abuse and were therefore not defamatory the verdict was against the weight of the evidence. [...] The Court of Appeal (three Judges to two) reversed the decision of the High Court of Toronto which was in Plaintiffs' favour and the Supreme Court of Canada by same majority affirmed the Court of Appeal so deciding for Defendants on the claim. [...] Whether either of these parties failed in the discharge of their part of the contract is absolutely and entirely a question of fact and the inference has been drawn from the circumstances of the particular case.
