In a previous suit by a morgagor to recover mortgaged properties on the ground that the mortgage debt had been discharged by the pament of a half to the Defendant in that suit and the other half to some other persons who were joined as pro forma Defendants the relief asked was refused and the morgagor was directed to pay the whole debt to the Defedant as a condition to his recovering [...] Held that the puchase being contrary to public policy the heirs of the Kanongo were not entitled to claim the benefit of the purchase. [...] The plan of the first portion which deals with the principles of contract is to set out the general principles as embodied in the Indian Cotract Act and to illustrate them by reference to the leading English decisions. [...] After referring to the authorities above named the Master of the Rolls said it was clear in this case that the term of the policy with which they had to deal with was a term as regards the risk it was therefore by the agreement eonetitnted a condition. [...] 117 was a cletrwt of rioting the alleged common object oil which wee to alm by force two women from the lawfld custody of the Police one of the women being the wife of one of - the Petitioners.
