The Corporation at their meeting accepted the above reeDmmendation of the majority of the Committee and resolved to advertise for candidates as soon as the sanction of the Local Government to the creation of these new appointments had been obtained. [...] Having regard also to the fact that the Law Reports Act (II of 1875) was one of the few acts where the Secretary of State in Council thought fit to exercise their right of vetoing an Act passed by the Indian Legislature the Legislature is not likely to repeat the folly. [...] It was held that the cotract was void but the mortgage was not void so the 'mortgage could be enforced by the sale or otherwise of the mortgaged properties to realise the money due but the personal covenant of the mortgagor could not be enforced. [...] Sheriff of Calcutta and knew his signature and that he had seen the endorsement on the writ of summons in this suit and the Bengali signature appearing at foot of return of the service and that the same was the signature of the said Kissen Singh and further stating that the said Kissen Singh was not to the best of his knowledge then in Calcutta. [...] Held—That the plaint having been written on a paper insufficiently stamped and the Plaintiff having failed to supply the deficit Court-fee stamps within the time apointed by the Court it was the bounden duty of the Court to reject the plaint.
