The notification that was issued to the Press puporting to announce the result of the meeting of the Judges under the presidency of the Lord Chancellor was in every way unsatisfactory and it is difficult to see how any member of the Bench who carefully and impartially considered the question could have come to any other conclusion but that the proposed alteration was desirable. [...] In Mahal& v. Ranjor at p. 163 it was held that a suit in the Civil Court for ejectment on the ground of the Defendant being a trespasser is not barred by the rule of res judicata merely because a suit to eject brought in the Revenue Court on the ground of the Defendant being a tenant was rejected on the finding that the Defendant was either the owner or a rent-five tenant of long standing an [...] The "Index " or rather the Digest of Cases as the issue in hand Shows covers a wide field including as it does not only the reported decisions of the four High Courts but of the Chief Court of the Punjab and of the Courts of the Judicial Commissioners of Oudh and Nagporo as well. [...] The first passage occurs at the end of the 1st article just preceding the enumertion of pensioners and is as follows:— "Should any of the pensioners enumerated in this deed or their heirs go and reside within the terrtories of the Honorable Company the Resident for the time being shall cause their pensions to be remitted to their place of residence." The Subordinate Judge held that " t [...] But the papers were returned to the Petitioner's solicitor on the ground that no affidavit as to the identity of the person executing the power of attoney with the person named in the Will as executor had been produced.
