In the above case it was said " there must be reasonable evidence of negligence that where the thing is solely under the management of the Defendant or his servants and the accident is such as in the ordinary course of things does not happen to those who have the management of machinery and use proper care it affords reasonable evidence in the absence of eplanation by the Defendants that th [...] The lands now vested in Plaintiff for the residue of the term and he claimed the benefit of those options as the assignee of the terms The Defendants were as trustees the owners of the fee simple. [...] The learned Judge in his address to the jury said inter alia that there was evidence that the testator was under the erroneous impression as to the necessity of cutting off the signature and upon the finding of the jury pronounced for the Will. [...] Court (of the Magistrate) Ify either party as a mere right to ferry independent of the.right to the land on each side of the eater but on the contrary the dispute was said to be concerning the ferry ghat and further as during the course of the arguMent the pleader of the 'Petitioner submitted to the Deputy Magistrate that the subject-matter o the dispute being ea 'ferry including land and wate [...] The Court of first instance decreed the claim for the share in the two motizahs but dismissed the suit in respect of the Wag lands.
