The Monlavi who was the manager under the Court of Wards of the Khagra Estate at the time reported to the then Sub-Divisional Officer of Kissengunj that one Ashgar Reza disputed the possession of the land with the Estate and requested that a police-officer be deputed to visit the spot and make a report. [...] The mortgagees subsequently i. e. after the due date sued for recovery by sale of the properties in the hands of the pnrchasers of such portion of their debt as had not been realised by the sale in execution of their decree against the mortgagors. [...] If calculated according to the current Bengali Wender the notice was one to quit after the expiry of six mouths and after the end of the year of tenancy. [...] On appeal the Subordinate Judge came to the finding that " the Defendants' pottah was got up by the landlord in order to defraud the Plaintiff of this land But the evidence on the record shows that the landlOrd had no direct hand in the ouster;" and he held that Art. [...] 2 paid to the zemindar at 30 years' purchase and took into consideration the liability of the rent to enhancment and awarded to the Appellant the zemindar that capitalized value and also a like amount as the value of the chance of enhancement.
