A VERY SERIOUS DIFFICULTY IN THE CASE AROSE OUtI of the pleading in the case that the cause of action had arisen on the 16th of May 1887 the date on which right of suit accrued to the mother and.that was some months before the Plaintiff was adopted. [...] There is also the affidavit of a gentleman who is personally acquainted with the executants and their family he did not identify the persona who executed the power-of-attoney before the Notary and he omits to say whether he is acquainted with the hanwriting of the exeentants and whether the signtures on the power of-attorney which was shown to him are in the handwriting of the persons w [...] The lower Appellate Court set aside that judgment and dismissed the Plaintiff's suit upon the grounds that the tank was dug for the purpose of providing good drinking water to the Defendant and his people that this was in no way inconsistent with the purpose for which the land was let out and that the act of the Defendant was an improvment within the meaning of sec. [...] The Plaintiffs *plied on the 22nd July to have the decree amended and the amendment was made on the 22nd August The appeal was filed on the 2nd Septeber that if within 30 days of the date of the amended decree. [...] The Plaintiff sued to recover the sum of Rs 28-fi pies as arrears of rent for the years 1306 to 1308 or in the alternative the same amount as compesation for the use and occupation of the lands specified in the plaint by the Defendants during those years.
