The Partition of Bengal the proposed City Civil Court the scheme for the extension of the jurisdiction of the Presidency Small Cause Court besides open gibes and taunts against the work of the High Court well shewed His late Excellency’s antipathy to the highest tribunal of justice in this province. [...] To all but the narrowest minded of statesmen the maintenance of the independence and authority of the Courts of Justice should he one of the axioms of good government. [...] The scheme formulated bythe High Court directed the surplus income to be applied for the establishment of a College for the promotion among Hindus of a knowledge of their religion with a library attached and residential quarters for the teaching staff the distribution of prizes and lastly for the construction of roads and providing a good water-supply to the hills. [...] Ross for the Appellant submitted that the construction of the various sections of the Transfer of Property Act mentioned in the judgment of the High Court was erroneous and since the delivery of the High Court judgment had been held to be so by their Lordships in the Maharaja of B/arapur v. Ram Kanno Dei (L. [...] But the learned Sessions Judge practically took the detemination of this question out of the hands of the jury and directed them that falseness of at least a part of the evidence would not justify them in discrediting the rest of the prosecution story.
