Then the Court is incompetent to decide the civil rights but it considers the civil rights of the parties to the proceedings in so far as they affect the question of the criminal liability of one of them. [...] 1 of Act III of 1867 even when the profits of the keeper are derived not from payments for the use of the house or instruments of gaming but from the game itself by reason of the odds being always in favour of the bank. [...] The Company now sought confirmation of such resolution and the question for decision was whether the above section allows a contingent notice of a meeting; The section says "Notice of any meeting shall for the purposes of this section he deemed to be duly given and the meeting to be duly held whenever such notice is given and meeting held in manner prescribed by the regulations of the Company." [...] There was no appropriation of any portion of the rent to the jote jatnas as distinguished from the putni taint's and the Collector refused the application saying that the case did not fall within the Regulation. [...] Held—That it is not the geographical situation of the land that is to be looked into but the tranfer is to be made to the proprietor of the estate within which such lands may be situated and this means that the transfer is to be made to the zemindar of the estate to which the lands appetain and of which they form a part and parcel.
