Then it is by keeping the control of the High Court of Judicature at Fort William in Bengal over the whole of the Magistraey and Judiciary in both the provinces in the Presidency of Bengal unipaired that justice can he assured to the people of both provinces ; otherwise the people in the new Province will soon lose faith in British justice as well. [...] The English Legislature is apparently more jealous in guarding the interests of the subjects against the possibility of capricious action on the part of the executive Government than the Indian. [...] The two elder sons of the testator's brother named in the Will were both dead and the question was whether third son was to be deemed to be born in the testator's lifetime" within the meaning of the Will. [...] Subsequenly however upon the Plaintiff's bringing suits against the tenants of the village for the realisation of rents the Defendants intervened and stated that they were in possession of the village by virtue of the said ijara lease executed by the Plaintiff; and the suits were dismissed on 29th September 1896. [...] 181 Bengal Tenancy Act wee' a bar to Plaintiff's suit; (2) the acquisition of the right of occupancy was inconsistent with the nature and incidents of a ghatwali tenure; r3) upon the finding of the Court below the Plaintiff had posesion only after the Bengal Tenancy Aot came ifito operation and the question of acquisition of right of occupancy by custom or local usage did not arise in the case
