The object of the Bengal Government in initiating this measure evidently was to fortify itself with the opinion of some of the more influential public bodies in Bengal and to go up to the Government of India for the amendment of the Regulations on the lines suggested. [...] The difference of opinion arose with regard to the question whether a deed of charitable trust was real or colourable only and whether from the circumstance that one of the executants of the deed stood in the relation of son to the other oxecutant it skould be presumed that the latter had exercised undue iMance on the former in procuring his assent to the deed. [...] The Master of the Rolls first disposed of the argment on behalf of Plaintiff in support of the finding in the wife's favour based on the authorities as to mirepresentation on the sale of chattels of a dangerous character intended for the use of persons not parties to the contract such as George v. Skivington L. R. 5 Ex. [...] 54 which is the foundation of much of the law on the subject.." The learned President proceeds "that being the law in the State of Minesota similar to the Scotts law as to irregular marriages he had to find the facts on which the law had to be applied. [...] The principal ground of appeal was that the judgment of His Honour acting C. J. Smith was against the weight of evidence and the matter discussed was whether the message requiring the Respondent to attend the Omanhene's court for disregarding the oath was communicated to Ahinkra the head of the Respondent's family or whether no notice was given to the last named.
