The Roman Catholic Chaplain of the place coming to know of this will in all innocence of heart went over to the Judge's house and told him all about it and requested him to grant probate of the will to the said Rector who as he lielieved was under the terms of the will entitled to probate. [...] The differences between the provisions of the present Act and its predecessor are duly noticed and the provisionu of the act are further elucidated by extracts from the report of the select committee and High Court circulars The book will prove useful. [...] At the time of the trial of the case against the Petitioners the trying Magistrate was vested with the powers of a Magistrate of the second class. [...] 2 of the Code of Criminal Procedure the order of the Local Government had effect from the 26th April as regards the class of the Magistrate. [...] official acts must be presumed to have been done at the earliest part of the day we must hold that on the 26th April the last day of the trial the trying Magistrate was vested with the powers of a Magistrate of the first class from the earliest part of the day.
