At the date this order was passed the proprietor had paid in the Government dues but the office appropriated the payment to the September kist without bringing the fact of the payment to the notice of the Collector and the mehal was sold. [...] The basis of the contention was a misconception of the effect of a dictum in Campbell v. Spottiswood 3 B. and S. 769 and approved of in Merivale v. Carson and after shifting those cases the Master of the Rolls said the acceptance of the dictum under consideration 266"VOL. [...] In either case the question raised is really as to the state of mind of the Defendant when he published the alleged libel the question being in the one case whether he published it in the spirit of malice in the other whether he published it in the spirit of unfairnes11. [...] The evidence on the record against the accused proved the following (1) that the Cadastral Survey Record does not contain the word " Dutt " in the two entries containing the name Mohesh Chandra ; (2) that the addition was discovered if the Court of the Munsif but when and how the alteration was made was "bot clear and there was no evidence on the point.
