507 in which as pointed out by their Lordships. the subject matter of dispute is not capable of definite possession and the parties practically occupy the position of counteclaimants that the onus proof cannot be thrown on Miler party exclusively and the claim decreed or dismissed according as the one or the other party fails to discharge that onw. [...] It is not very clear what may be the significance of the term "primarily." It is well-known that when a putni is created the putnidar acquires all the rights of the proprietor as to the settlement of land with the tenants. [...] One of the objects of the translators has been to adapt the work to " Indian and Colonial Pratice." We are not sure that it would not be the better plan to preserve the orloinat in its integrity in the translation and to issue a companion volume eiellndying points special to India and the Colonies. [...] The conditions prevailing in these countries the habits and practices of the criminals the mode of living of the people and the very physical characteristics of the countries themselves are so widely different that it would require a much larger volume than the present to supply the needs of police-officers of all these countries. [...] On the other hand he would gain much if he tried to work in the spirit of the author of the treatise.
