IN VIEW OF THE SEPARATI8N OF THE EXECUTIVE and the judiciary we must observe that it is incubent on the Government of India and the Secretary of State in Council to try and obtain the best men available either in this country or in England for the High Court Benches. [...] 15 of the Charter and it was contended on his behalf that the Kumar's claim was not entetained and the Subordinate Judge in his judgment in the claim case held that the claimant cannot question the propriety of the attachment.
