But we express the opinion of the major portion of the legal profession in suggesting that if the vacation commenced at least a week later and the Courts re-opened after the Ka tik poojah i.e on the 18th November instead of on the 11th it would have been far more cmvenient to the solcitors of the Court and also to the suitors. [...] It will be seen from the holiday list that after the re-opening of the Court on the 11th of November the Court will close two days after for the rest of the week on account of the Jagadhatri poojah and Kartik poojah. [...] Applying this principle the Chancery Court found that inasmuch as the amount of obstruction complained of could not support an action on the part of the dominant owner before the dominanr tenement was rebuilt such obstruction could not be a ground of suit after the dominant tenement was rebuilt even though by reason of the rebuilding of the partial obstruction the total quantity of the ancient l [...] Where the widow transferred all her rights in all the debutter properties inherited by her from her husband in order that the donees might safeguard the debutter and the said transfer was necessitated by the wrong-doing of the reversioners the gift was held to be binding on the reversioners. [...] The true purpose of a concession of a right of suit in these cases is the protection of the rights of the person who may eventually turn out to be the heir and the object of the legal proceeding is perpetuation of testimony which might not be avaiable to the heir by lapse of time when the succesion actually opens.
