The result of the deliberations of the Committee is the Bill in the present forrn. [...] 110 one would have expected that at the next revision of the Code the legislature would leave no loophole in the procedure of the trial of these cases likely to give -a chance to the course of justice being tampered in any way by executive bias or the zeal of the police but this amendment has gone just the other way. [...] 123 is to be amended so that if security has been required in the course of the same proceedings from two or more persons in respect of any one of whom the proceedings are referred to the Sessions Judge or the Nigh Court the period of the bond being more than one year such reference shall also include the case of all other persons ordered to execute bonds irrespective of the period of their bond [...] The reason of the rule of course is that the appearance of a solicitor in the double role of witness and lawyer for the party in whose bhalf he testifies cannot but be prejudicial hishis client because of his obvious interest in the outcome of the suit so that neither the Judge nor the jury would be likely to give the same weight to his testimony as would be given to it if it appeared that [...] The Court graned the application for an order directing the ssum-nons with a of the retiti on to be sent tAi the and Admiralty Division of the Hi h cicut of England for transmision to the foreign (Ace fur service unon the Respondent.
