Sir John Trevelvan a well-known ex-Judge of the Calcutta High Court and now Reader of Indian Law at the Oxford University writes to the Journal of the Society of Comparative Legislation pointing out the legal anomalies of a marriage between an Indian and English woman in England. [...] We thormody endorse the views of Sir John Trevelvan when he says :—“In applying the rules of equity and good conscience which they are bound to apply in the absence of express provision of the law Indian Courts would undoubtedly accept the view of the English Courts as to the status of the huband and wife (i.e. [...] The extract below is taken from the last report of the Bar Council and it will surely afford guiance to members of the legal profession in this country as well :— The Council have been asked by a County Coln Judge to consider the possibility of framing some general rules for the guidance of Counsel who are instructed. [...] The question of the validity of a transfer in favour of a minor came to attract notice only after the Judicial Committee poined out the complete invalidity of a minor’s cotract and all controversies over this matter really date from the time. [...] Since the passing of the Contract Act and the Transfer of Property Act a ci many years have elapsed ; and a good many years have also passed away since the decision of Mohor; case and the I Legislature by its n m-interference has fully indicated its approval of the rule of that leading case.
