It is with a sense of great pain that we have received the sad news of the death in the battlfield of France of the eldest son of the lion’ble Mr. [...] The Court while holding that the terms of the copromise regarding the taking of the lease `Nero binding on the Defendant as an agreement observed : " We think that in execution of the decree itself the amount agreed to be paid as damages could alone. [...] The High Court in its insolvency jurisdiction can try the question whether certain property situate outside the local limits of the Original Civil Jurisdiction of the Court belongs to the insolvent. [...] The document was proved by a copy the copy bearing the seal of the Colletorate and &facsimile signature of the Deputy Collector. [...] 76 of the Indian Evidence Act However in a matter like this it is a pure technicality and the Plaintiff ought to have an opportunity of proving the valuation roll in a proper Manner and the case must go buck to the first Court on Plaintiff's paying the Defenant the costs of the remand in this Court and in the lower Courts.
