It is with a sense of great pain that we have received the sad news of the death in the battlfield of France of the eldest son of the lion’ble Mr. [...] The Court while holding that the terms of the copromise regarding the taking of the lease `Nero binding on the Defendant as an agreement observed : " We think that in execution of the decree itself the amount agreed to be paid as damages could alone. [...] 76 of the Indian Evidence Act However in a matter like this it is a pure technicality and the Plaintiff ought to have an opportunity of proving the valuation roll in a proper Manner and the case must go buck to the first Court on Plaintiff's paying the Defenant the costs of the remand in this Court and in the lower Courts.
