Exoneration from the suit may be due to various causes and the question whether a party remains on reefed for the purpose of sec: 47 in spite of such exoneration will depend upon the nature and scope of the order having regard to the pleadings and the reason which led to such exoneration. [...] The exoneration in the present case having beet; ott the grounil of the patty whose claim Was nit adjudicated upon did not remain a party to the suit for the purposes of sec. [...] 2 500 and had nusappropifittet the amount by forging the names of the deposit ors on the back of the P. Notes anti selling them. [...] Thereupon the Petitioner apPlied for revival of his case which matter was trans= ferred by the Chief Presidency Magistrate to the Fourth Presidency Magistrate the Thud Presdency Magistrate having already retired but the application for revival was refused and the Petitioner was referred to the Civil:Court for the recovery of his G. P. Note. [...] Against the decree in favoor of the Plaintiff made by the Court of first instante the Defendant appealed to the District Judg4 who adopted the following.
