The elements of strength of the Judicial Comittee are thus summed up by the writer The elements of strength of the Court are many and great; its independence and aloofness the integrity and high rputation of its members ; their power of looking with clear eyes on facts sometimes seen elsewhere through the mirage of local prejudices a sense of responsibility and of the tradtions of the [...] Although the excellent scheme formulated by Lord Morley has been marred in this manner yet there are certain provisions in the Statute of 1909 especially those relating to the enlarged powers of the new Council which being beyond the rule-making powers of the Indian Executive have survived the operation to which the rest of the scheme has been subjected at Simla. [...] Hitherto the principle underlying the admission of Indians to the Legislative Council has been that in legislating for the people the Executive Government should be assisted by a knowledge of the thoughts and feelings of the people. [...] 103 1. P. C. on the allegation that the coplaint of the Petitioner against Dwaraka Prasad and the subsequent proceedings thereon were all collusive transactions gone through for the purpose at throwing obstacle in the way of his (Bejoy Kumar Saha's) enforcing the contract under Act XIII of 18;9 entered into by the said Dwaraka Prasad on the 5th March 1909 and for the enforcement of which he h [...] by the end of the year 1306 F. S. the villages were to go back to the possession of the proprietor free of the incumbrance created by him from the beginning of the year 1307.
