We are afraid that it would be going against the spirit of the revisional sections of the Code of Criminal Procedure if the High Court were to reject an application merely on the ground of delay and without looking into the facts of the case to see whether the delay should in the circustances of the case be regarded as fatal to the application. [...] The effect of the rule of strict construction might almost be summed up in the remark that where an equivcal word or ambiguous sentence leaves a reasoable doubt as to its meaning which the canons of interpretation fail to solve the benefit of the doubt should be given to the subject and against the Legislature which has failed to explain itself. [...] Where a mortgagee decree.holder after obtaining permission of the Court to purchase the mortgaged property at a price fixed by the Court purchased the same in the name of a third party at a price far less than the minimum price settled by the Court held that the act amounted to a fraud and that the confirmation of the sale was no bar to the setting aside of a sale at the instance of a party who [...] The popularity and success of the work is testified by the large number of editions which the hook has passed through within a short time and there is no doubt that the Digest has been a valuable aid to the administration of customary law in the Punjab. [...] This was an appeal by the decree-holder against the judgment of the District Judge of Pubna and I3ogra affirming the order of the Subordinate Judge assessing mesne profits on the basis of rental.
